The petitioner seeks bail in S.C.No.276 of 2009 in which Non Bailable Warrant was issued against him on 29.07.2016 and thereafter, he had surrendered before the Court only on 20.07.2023. 2.The petitioner has been evading judicial process for nearly about 7 years. No trial can progress if one of the accused absconds from the judicial process.

3.It is also seen that as against A7, the case had been split up and as against A5, it is still in P.R.C stage. Once the charges are common against all the accused, if trial is to be split up because the accused absent themselves, then the prosecution can never establish the charges. The witnesses would also fade away.

4.In view of all these facts even though the learned counsel states that the other accused had been granted bail, this Court is not inclined to grant bail to the petitioner.

5.Hence, this Criminal Original Petition stands dismissed. 6.It is to be noted that the petitioner should be under incarceration till completion of the trial.
