ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2.

This Case in Cr.No.121 of 2012 is registered for the alleged offence under Sections 341, 324, 323 & 506(i) of Indian Penal Code. It is stated that the defacto complainant has since died. The accused are not residing at Puducherry, but are now residing at Chennai for their avocation. Therefore, there is no any circumstances of both sides coming into contact Page No.1 of 3

with each other. The matter is pending for the past 13 years. Even now the summons were not served and as such, the Court has issued bailable warrant. Any service of summons hereafter and bringing the accused to books, will violate the right to speedy trial of the accused. 3.

Accordingly, the proceedings in STC.No.3905 of 2024 on the file of the learned Judicial Magistrate VI, Puducherry Taluk, Puducherry is quashed and this Suo Motu Transfer Case is disposed of. 01.09.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
