CMP No.25738 of 2023 in CMA SR No.135194 of 2023 N.ANAND VENKATESH,J The respondents have been served with notice. The first respondent is represented through a counsel. Mr.J.

Michael Visuvasam, learned counsel undertakes to file vakalat on behalf of the second respondent.

2. This civil miscellaneous petition has been filed seeking to condone the delay of 356 days in filing the main civil miscellaneous appeal.

3. Heard the learned counsel for the petitioner and the learned counsel for the respondents and perused the records.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the civil miscellaneous petition is allowed and the delay of 356 days is condoned.

5. Registry is directed to number the main civil miscellaneous appeal and list the same for admission. When the matter is posted for admission, the name of learned counsel for second respondent shall also be printed in the cause-list. In the meanwhile, the learned counsel for the petitioner/ appellant shall serve papers on the learned counsel for the second respondent.
