ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for alleged offence under Section 379 of the Indian Penal Code. The incident occurred on 06.07.2022. The de facto complainant is present before this Court. He is willing to get return of his property. Upon formal application or even otherwise upon the de facto complainant being present before the Trial Court, the Trial Court is directed to Page No.1 of 3

return the articles. Considering the fact that the accused is elusive and the matter is long pending, no meaningful trial is possible hereinafter and even if summons are served on the accused and the accused is brought to face trial, it will also impinge upon the right to speedy trial of the accused. It is stated that there are no other antecedents of the accused.

3. Accordingly, the case in C.C.No.81 of 2022 of Judicial Magistrate Court, Udhagamandalam Taluk, Nilgiris, stands quashed. This Suo Motu Transfer Case is disposed of.

09.09.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
