Respondent(s) PRAYER This Writ Petition is filed under Article 226 of the Constitution of India,seeing for a Writ of Mandamus, directing the Respondent Corporation to return the amount of Rs.1,00,000/- (One Lakh Rupees) paid by the petitioner to the Respondent Corporation through Demand Draft No.782587 dated 25.10.2018 drawn from State Bank of India, Kovilpatti Branch as the Deposit for Digital Signal Distributor licence as recorded in the office communication dated 15.11.2018 vide T.N.A.C.TV. 101/ 2018 sent by the 2nd respondent to the 1st respondent, along with interest at the rate of 8% till the date of payment to the petitioner from 29.08.2020 on which the petitioner made representation for return the amount of deposit, based on the petitioner's further representation dated 09.05.2022

ORDER
This writ petition is filed seeking for a direction to the Respondent Corporation to return the amount of Rs.1,00,000/- (One Lakh Rupees) paid by the petitioner to the Respondent Corporation through Demand Draft No.782587 dated 25.10.2018 drawn from State Bank of India, Kovilpatti Branch as the Deposit for Digital Signal Distributor licence as recorded in the office communication dated 15.11.2018 vide T.N.A.C.TV. 101/ 2018 sent by the 2nd respondent to the 1st respondent, along with interest at the rate of 8% till the date of payment to the petitioner from 29.08.2020, on which date the petitioner made representation for return the amount of deposit, based on the petitioner's further representation dated 09.05.2022.
2.The case of the petitioner is that the petitioner is a registered Local Cable Operator (LCO) with the respondent Corporation. He applied for the Digital Signal Distributor License in the year 2018 and paid an amount of deposit of Rs.1,00,000/- through Demand Draft to the Respondent Corporation. In the year 2019, he once again applied for Digital Signal Distributor license and paid an amount of Deposit of Rs.50,000/- through Demand Draft to the Respondent Corporation. Both licenses were not allotted to him. Therefore, he requested to return the deposited amount on 29.08.2020. However, the
Respondent Corporation returned Rs.50,000/- alone to the petitioner on 27.08.2021 through Bank transfer. Thereafter, the petitioner sent a representation dated 09.05.2022 to the Respondents seeking the return of Rs.1,00,000/-. However, no action has been taken till date. Hence, the present writ petition.
3.The learned counsel for the petitioner would submit that a direction be issued to the respondents to return the sum of Rs.1,00,000/- to the petitioner by considering the petitioner's representation dated 09.05.2022. 4.The learned counsel appearing for the respondents would submit that the demand draft issued by the petitioner was not encashed by the respondents and that presently, the demand draft issued by the petitioner is not available with the respondents. However, he submits that the respondents will issue a no objection certificate to enable the petitioner to encash the demand draft, which is lying in the petitioner account.
5.In view of the above, the writ petition is disposed of with a direction to the respondents to encash the demand draft and thereafter, to return the sum of Rs.1,00,000/- without interest to the petitioner or in the alternative, to issue a no objection certificate to the petitioner, to enable him to encash the demand draft which was deposited in the State Bank of India, Kovilpatti Branch. The said
exercise shall be concluded within a period of four (4) weeks from the date of receipt of a copy of this order.
