C.M.P.No.12933 of 2017 has been filed to appoint an Advocate Commissioner to measure and demarcate the suit property. 2.The Respondent/Plaintiff filed a suit for injunction on the strength of the Will. Identification of the property for injunction decree is disputed. The trial Court decreed the Suit, Appellate Court dismissed the Appeal and hence, the Defendant has preferred this Second Appeal. Though the property is of a larger extent only a smaller extent has been covered under the Will. Since it is for an injunction, identification of the property is mandatory. In the interest of justice, C.M.P.No.12933 of 2017 is allowed.
3.Mr.D.Ravichander, (Mobile No.9442135959), Advocate, No.1194, 6th Avenue, G Block, 14th Street, Anna Nagar, Chennai 600 040, is appointed as an Advocate Commissioner. The Advocate Commissioner shall take the assistance of the Taluk Surveyor with revenue records. Both the parties are directed to cooperate with the Advocate Commissioner, appointed by this 1/3
Court. The Advocate Commissioner shall inspect the property and file a report within a period of eight weeks. The initial remuneration of the Advocate Commissioner is fixed at Rs.10,000/- (Rupees ten thousand only). Post the matter after eight weeks.
