The petitioner seeks anticipatory bail in Crime No.223 of 2020 registered under Sections 8 (c) r/w 20 (b) (ii)(B) NDPS Act. 2.After more than three years, the petitioner today seeks anticipatory bail. It is stated that the respondent had seized 2.100 Kgs of ganja from A1.

3.The learned counsel for the petitioner states that there are no allegations as against the petitioner herein and it is stated that A1 had only stated that he along with others were having ganja. It is stated that there are no antecedents against the petitioner herein. 4.But, however, on the side of the respondent, a counter has been filed, wherein, it had been stated that investigation has been completed showing the petitioner as an absconding accused. 5.In view of that particular fact, the petitioner having the benefit of being free for more than three years, I am not inclined to grant anticipatory 1/3

bail to the petitioner herein. If required, the respondent may also conduct further investigation after getting permission from the concerned jurisdictional Court with respect to role of the petitioner herein.

6. Accordingly, this Criminal Original Petition stands dismissed. sli 28.11.2023 2/3
