The petitioner is the accused No.15 in S.C.No.248 of 2022, in which, the trial is ongoing before the learned XXI Additional Judge, Allikulam, Chennai.

2.It is stated that Non Bailable Warrant was issued against the petitioner on 02.09.2022 and executed after more than 10 months only on 06.06.2023.

3.It is also seen that as against A8, A11 and A14, Non Bailable Warrants are still pending.

4.The accused had taken a decision to alternatively absent themselves. The trial can never proceed.

5.Hence, this Criminal Original Petition stands dismissed. 6.It is to be noted that the petitioner should be under incarceration till completion of the trial.
