ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.This case in Cr.No.380 of 2012 dated 18.09.2012 was registered for the alleged offences under Sections 279 and 304(A) IPC r/w. Rule 174 r/w. section 177 M. V Act & Section 194 r/w. Section 133 M.V Act, It is reported that the defacto complainant has already filed claim petition and compensation has been awarded and he does not want to pursue the case any further and the case is pending at summons stage.

3.Considering the nature of allegation, the antecedents of the accused, the reason for absence from his usual place, and the submission that, despite best efforts, summons could not be served, it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

shl 4.Accordingly, the case in CC.200281/2013 on the file of the Judicial Magistrate Court, Sangarapuram stands quashed. This Suo Motu Transfer Case is disposed of.
