ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2.

The allegations in this case is that on 03.03.2018, the accused and 28 others, protested against the Central Government, without obtaining any prior permssion.

A case was registered in Cr.No.122 of 2018 on 03.03.2018 for the alleged offences under Sections 143 & 188 of Indian Penal Code. The final report was filed on 05.03.2018 and the accused have been facing trial since then. Thus, it can be seen that the allegations concern exercising the democratic right to protest. Given the context and nature of the allegations, continuing the trial impinges on the right to a speedy trial of the accused. No useful purpose will be served by continuing the case. 4.

Accordingly, the proceedings in CC.No.11267 of 2018 of XXIII Metropolitan Magistrate Court, Saidapet Taluk, Chennai is quashed and this Suo Motu Transfer case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
