A.Nos.5529 to 5531 of 2022 A.Nos.5529 to 5531 of 2022 in C.S.No.665 of 2019 C.V.KARTHIKEYAN,J., The defendants had been set ex-parte. The plaintiff was directed to tender evidence. The witness for the plaintiff appeared before the learned Additional Master No.1, on 04.11.2022 to tender evidence. Evidence was recorded and Exs.P1 to P34 were marked. The plaint document No.20 was a Bank Statement from the Axis Bank for the period 01.01.2018 to 11.07.2018. The witness had only the Xerox copy. The learned Additional Master No.1 did not permit marking of the Xerox copy and closed the evidence.

2. These three applications have therefore been filed to reopen the evidence, to recall the witness and to mark the original statement as certified by the Bank Authorities.

3. In view of the fact that those statements are required to examine the issues raised and to adjudicate the claim made by the plaintiff, I would permit all the three applications and direct the witness of the plaintiff to once again appear before the learned Additional Master No.1 on 14.12.2022. Consequently, the evidence stands reopened. The witness is permitted to mark the Bank Statement as now produced as further evidence.

4. List the matter after the evidence is recorded in full by the learned Additional Master No.1.
