ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for an alleged offence under Section 229A of the Indian Penal Code. The allegation in this case is that the accused, who is facing one previous case of murder, did not appear in the murder case inspite of the condition imposed in bail and as such, an offence under Section 229A of the Indian Penal Code was registered. It is stated that subsequently, the accused was brought to books and he faced the trial in the murder case and that Page No.1 of 3

said case ended in acquittal. Now, this case, registered for the offence under Section 229A of the Indian Penal Code, is pending from the year 2022. It is stated that the accused is not involved in any other case and he is working as a labour in Kerala. The police is not able to trace out the correct address and serve the summons on accused. Considering the nature of allegations, overall facts and circumstances of the case, even if summons are served on any future date, it would impinge upon the right to speedy trial of the accused.

3. Accordingly, the case in S.T.C.No.367 of 2022 of Judicial Magistrate Court No.II, Villupuram Taluk, Villupuram, stands quashed. This Suo Motu Transfer Case is disposed of.

02.09.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
