Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the Third Respondent to dispose of the appeal dated 10.08.2019 filed by the Petitioner under Section 3(2) of the Tamil Nadu Electricity Board (Recovery of Dues) Act within time frame, till such time the Respondents are preclude from demanding any money from Petitioner.

O R D E R

The Writ Petition has been filed for a direction to the Third Respondent to dispose of the appeal dated 10.08.2019 filed by the Petitioner under Section 3(2) of the Tamil Nadu

Electricity Board (Recovery of Dues) Act, 1978, within time frame, till such time the Respondents shall be precluded from demanding any money from Petitioner.

Mr. Vijayamehanath, Learned Standing Counsel appearing for the Respondents, on instructions, states that enquiry on the appeal filed by the petitioner has been fixed at 11.00 a.m. on 18.02.2020 before the Third Respondent and he has produced a copy of the notice for the same. Learned Counsel for the Petitioner acknowledges its receipt.

The Third Respondent shall ensure that there is atleast one effective hearing every week showing progress of the case. After affording full opportunity of hearing to all parties concerned, the Third Respondent shall consider each of the contentions raised by the parties and pass reasoned orders on merits in accordance with law, and shall communicate the decision taken to the Petitioner under written acknowledgment and report of such compliance shall be filed before the Registrar (Judicial) of this Court by 30.06.2020.

The Writ Petition is disposed on the aforesaid terms. No costs.
