Though service of Court notice is awaited, it seen from the affidavit of service filed by the learned counsel for the petitioner, the 29th respondent, who is the legal representative of the 2nd respondent has been served privately on 02.11.2023. Despite such service, he has not chosen to appear either in person or through counsel, duly instructed. 2.Accepting the reasons assigned in the affidavit filed in support of the petitions, these petitions are ordered, the delay in seeking to set aside the abatement caused by the death of the 2nd respondent is condoned, the abatement caused by the death of the 2nd respondent is set aside and the respondents 27 to 29 are brought on record as legal representatives of the deceased 2nd respondent and ranked as respondents 27 to 29 in the appeal.
