PETITION under Section 482 of the Criminal Procedure Code praying direct the respondent Police to continue the investigation in Cr.No.265 of 2019 on the file of the respondent Police and trace the forged document purportedly executed by late Shri.Bhanumathi Ramakrishna in favour of the accused (1) V.Balu, (2) C.Palanivel and

(3) R.Parthasarathy dated 05.3.1998, 14.3.2002 and 11.1.2002 respectively.

ORDER

This is a petition filed by the petitioner seeking a direction to the respondent to proceed with the investigation in Cr.No.265 of 2019 and to trace the forged documents.

2. I have heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent.

3. When the matter is taken up for hearing, the learned Government Advocate (Crl.Side), on instructions, has submitted that the investigation has been completed, that a final report has been filed before the Special Court dealing with CCB/CBCID Cases, Egmore, Chennai and that the same had been taken on file in C.C.No.15796 of 2022. He would further submit that the case is now posted on 07.7.2023 for appearance of the accused persons.

4. In turn, the learned counsel for the petitioner has submitted that this Court directed the respondent Police to file a status report with regard to the reasons for not securing the forged document. 2/4

In view of the fact that the final report has already been filed before the Court concerned, it is left open to the petitioner/defacto complainant to scrutinize the final report and if the petitioner has any grievance regarding the same, it is again left open to him to work out his remedy in a manner known to law. Except giving this clarity, no further orders can be passed in this petition.

6. The above criminal original petition is disposed of in the above terms.
