Before presenting this application, the applicant endeavoured to resolve the dispute through mediation. The non-starter report issued by Tamil Nadu Legal Services Authority is on record. The said document evidences that the first respondent filed a memo to the effect that the mediation may be treated as a non starter as regards the first respondent. The second and third respondents did not appear for mediation.
2. The applicant states that at least a part of the cause of action has arisen within the jurisdiction of this Court in view of the fact that the relevant insurance policy was issued by the first respondent by specifying that the servicing office is the Chennai office of the first respondent.
3. Upon considering the above and on examining the material documents, it appears that at least a part of the cause of action has arisen within the jurisdiction of this Court. Therefore, the applicant is granted leave to sue the respondents before this Court.
