ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for alleged offences under Sections 465, Page No.1 of 3

466, 468, 471 r/w 120(B) of the Indian Penal Code. The mother's case in C.C.No.241 of 2009, against accused Nos.1 and 2 was proceeded further and resulted in an acquittal. The grounds for acquittal also apply to the present accused. The matter has been pending for the execution of the warrant since long time. Considering the factual matrix, the context of the case, the background of the accused, the reason for his absence at his place of residence, and the submission made that, despite best efforts, the warrant could not be executed, it is clear that even if the accused faces trial, no useful purpose would be served.

3. Accordingly, the case in C.C.No.800128 of 2017 of Judicial Magistrate No.II, Krishnagiri Taluk, Krishnagiri, stands quashed. This Suo Motu Transfer Case is disposed of.

02.09.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned."
