Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the third respondent to conduct enquiry, as per the directions of the second respondent in his letter O.Mu.1050/2024/A3 dated 07.05.2024 and grant patta to the petitioner in respect of his property measuring an extent of 1.56 acres comprised in survey 1/5

O R D E R

The petitioner herein seeks a direction to the third respondent to conduct enquiry, as per the directions issued by the second respondent in his letter O.Mu.1050/2024/A3 dated 07.05.2024 and grant patta to the petitioner in respect of his property measuring an extent of 1.56 acres comprised in survey No.347/1 and 347/2, Malayam Bakkam Village, Kundrathur Taluk, Kancheepuram District, within a time to be stipulated by this Court.

2. By consent of both the learned counsel appearing for the petitioner as well as respondents, this writ petition is disposed of at the admission stage itself.

3. It is the case of the petitioner that the above mentioned property purchased by his father under sale deed dated 18.03.1971. Subsequently, he executed a settlement deed dated 23.11.2015 settling the property in favour of the petitioner. Based on the settlement deed, the petitioner submitted a representation dated 29.04.2024 seeking transfer of patta in his name. The second respondent forwarded the representation of the petitioner to the third respondent for taking appropriate action. Till date the third respondent has not taken any action. Hence, the petitioner is before this court.

4. Mr.S.J.Sathik Mohamed, learned Government Advocate, who takes notice for the respondents would submit that the representation of the petitioner will be considered on its own merits and appropriate orders will be passed.

In view of the above submission made by the Government Advocate, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the third respondent to consider the representation of the petitioner dated 29.04.2024 and pass final orders, after 3/5

issuing notice to all interested parties, within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
