SA.No.997 of 2022 C.M.P.No.21438 of 2022 in S.A.No.997 of 2022 G.K.ILANTHIRAIYAN, J.

This petition has been filed to grant an order of injunction restraining the respondents, their men, agents, assigns or any other persons claiming under them from alienating or encumbering the properties which is the subject matter of properties in O.S.No.86 of 2006 on the file of the learned Additional Subordinate Judge, Thindivanam.

2.

Heard Mr.D.Ravichander, the learned counsel appearing for the appellants.

3.

It is seen that the respondents are in possession and enjoyment of the suit property on the strength of the Will dated 04.09.2000, and both the Courts below categorically held that the Will has been proved by the respondents. Hence, the petitioner failed to make out prima facie case for the relief of injunction.

4.

Accordingly, the Civil Miscellaneous Petition stands dismissed. 14.12.2022 (2/2) rts https://www.mhc.tn.gov.in/judis
