ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2.

This Case in Cr.No.1978 of 2017 is registered for alleged offences under Section 324, 506(ii) of Indian Penal Code r/w 34 IPC. It is submitted that this case has a counter case in C.C.No.2346 of 2019. It is submitted that the accused who has given complaint in one case is absconding and remains untraceable till date. The complainant in counter case cum victim is present and submits that he does not want to pursue the matter any further. served and warrant is executed, in any future date, the same would impinge upon accused's right to speedy trial. Due to passage of time, no meaningful trial is possible and no useful purpose will be served. 3.

Accordingly, both the case in CC.2201/2019 and C.C.No.2346 of 2019 on the file of XXIII METROPOLITAN MAGISTRATE COURT, Saidapet Taluk, Chennai are quashed and this Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
