ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The occurrence in this case happened on 14.10.2011. The complainant is present and submits that his bike bearing Registration No. TN33 AY-4818 has already been returned to him. The Accused-2 died and Accused-1 remains continuously absent and non-bailable warrants could not Page No.1 of 3

be executed for the past 14 years despite best efforts.

3. Considering the long pendency, the complainant's stand and the fact that the accused remains untraceable, further continuation would impinge upon the right to a speedy trial. No useful purpose will be served by keeping the matter pending.

4. Accordingly, the C.C.No.100257/2012 on the file of the Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tiruppur shall stands quashed and this Suo Motu Transfer Case stands allowed. 10.09.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
