[Order of the Court was made by S.S.SUNDAR, J.] (1)The above Miscellaneous Petition is filed seeking modification of the condition imposed on the detenu vide order dated 06.10.2023 in WP.No.28622/2023.

(2)The learned counsel for the petitioner submitted that this Court vide order dated 06.10.2023, granted leave to the detenu from 16.10.2023 till 09.11.2023 with escort and the cost to be borne by the petitioner. It is submitted that the petitioner and the family members belong to agricultural family and that the economic status is poor and they cannot bear the charges for the escort/police personnel and hence, prays for modification of the said condition.

(3)Heard the learned Additional Public Prosecutor on the submissions of the learned counsel for the petitioner, who would request that the convict

prisoner/detenu shall report before the Annavasal Police Station daily until he is housed back in prison.

(4)In view of the above, para 5[c] of the order dated 06.10.2023, shall read as follows:- 5[c].The provision of minimum escort to the convict prisoner is dispensed with. The convict prisoner/detenu shall report before the Inspector of Police, Annavasal Police Station daily at 5.30 p.m., commencing from today [19.10.2023] till he is housed back in Central Prison on 09.11.2023.

(5)It is made clear that since escort has been provided from 16.10.2023 till today [19.10.2023] as per the order of this Court, the petitioner shall pay a sum of Rs.30,000/- [Rupees Thirty Thousand only] to the Superintendent of Police, Pudukottai District towards charges for providing escort to the detenu/convict prisoner for the above four days, i.e., from 16.10.2023 to 19.10.2023.
