ORDER

Today, the matter is listed under the caption "For Being Mentioned".

2. It is stated that the earlier order was erroneous, hence the earlier order is recalled and the following order is passed in this Suo motu TR.No.2004 of 2025:

"The case in C.C.No.100318 of 2012 was taken on the file of the Judicial Magistrate, Dharapuram, Dharapuram Taluk, Tiruppur for the alleged offences under Sections 279, 338 and 304(A) of IPC. The dependent of the victim has not filed any MCOP petition but however, they doesn't want to pursue the matter any further and they have no objection for closing the case.

2. Considering the factual matrix, context of the case and the submission that, the accused is said to be fully paralyzed on account of paralytic attack and is unable to move around. The medical records are also produced before this Court. In view of aforesaid reasons and the fact that the accused is bedridden, I am of the view that on humanitarian consideration, any further continuance of this case will be oppressive and cause prejudice to the accused.

3. Accordingly, the case in C.C.No.100318 of 2012 on the file of the Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tiruppur stands quashed. This Suo Motu Transfer Case is disposed of."

3. Registry is directed to upload the corrected order copy to the Court concerned.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
