ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The occurrence in this case happened on 27.07.2013. The complainant is present and submits that his vehicle, Mahindra Delivery van bearing Registration No. TN-19 E 5541 has been returned to him. The accused Page No.1 of 3

remains untraceable and fresh summons could not be executed despite best efforts.

3. Considering the long pendency, the complainant's stand and the fact that the accused remains untraceable, further continuation would impinge upon the right to a speedy trial. No useful purpose will be served by keeping the matter pending.

4. Accordingly, the C.C.No.900328/2013 on the file of the Judicial Magistrate Court No.II, Chengalpattu Taluk, Chengalpattu shall stand quashed and this Suo Motu Transfer Case stand allowed. 10.09.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
