A.No.5674 of 2023 in O.P.No.730 of 2021 N.SATHISH KUMAR. J., Though the application has been filed to transpose the applicants herein in the place of the deceased S.Ramamurthy in the above Original Petition and consequently, amend the main petition to grant letters of administration to the applicants for due prosecution.

2. It is transpired during the submissions that the third defendant is mentally disabled person. Such view of the matter, until his right are protected and guardian is appointed, this Court is of the view application cannot be entertained and the same is dismissed.

3. The learned counsel is directed to make necessary application to appoint the guardian for the third defendant.
