PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to pay the petitioner the difference/arrears of wages for the period from 01.09.2019 to 31.05.2022 and also terminal benefits namely Gratuity and Encashment of leave, after revising the same, based on the scale of pay payable to him on the month of his retirement as admitted by the respondent in the RTI information dated 12.09.2023, together with 18% interest per annum, within a time frame.

ORDER

With the consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

2. The prayer sought for in this Writ Petition is to direct the respondent to pay the arrears of wages for the period from 01.09.2019 to 31.05.2022 and the terminal benefits together with interest.

3. Though the petitioner had sought for disbursement of arrears of wages and terminal benefits, the learned counsel for the petitioner would submit that he would be satisfied if the petitioner's representation is considered within a stipulated time.

4. In view of the submission made by the learned counsel for the petitioner, there shall be a direction to the respondent herein to consider the petitioner's representation dated 20.09.2023, pass appropriate orders 2/4

in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any of its views with regard to the merits of the claim made by the petitioner and that it is open to the respondent to consider the same on its own merits.

5. With the above direction, the Writ Petition stands disposed of. No costs.
