2. This case is registered for alleged offences under Section 379 of IPC, 1860. The incident occurred on 06.04.2018. The allegation in this case is that Page No.1 of 3

the accused had stolen the Sintex Water Tank of the de facto complaniant, worth of Rs.36,000/-. The stolen property has been recovered and handed over to the de facto complainant.

3. Considering the nature of the allegations, context of the case, the antecedents of the accused, the reason for absence from his usual place, and the submission that, despite best efforts, the summons could not be served, and it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

4. Accordingly, the case in C.C.No.120 of 2018 on the file of Judicial Magistrate Court, Sriperumbudur Taluk, Kancheepuram, stands quashed and this Suo Motu Transfer case is disposed of.
