ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The allegations in this case are that on 04.08.2015 at about 12.20 p.m., the accused (A1 to A8) unlawfully assembled near TASMAC Shop No.2035, Sulagiri to Hosur Road, Millath Nagar, obstructed the movement of vehicles, and despite police advice to disperse, continued the protest. further alleged that they attempted to damage the TASMAC shop. Accordingly, a case was registered in Crime No. 548 of 2015 on 04.08.2015 for offences under Sections 143, 341, 188, of Indian Penal Code, 1860. The final report was filed on 06.08.2015, and the accused have been facing trial since then. Thus, it can be seen that the allegations concern exercising the democratic right to protest.

3. Given the context and nature of the allegations, continuing the trial impinges on the right to a speedy trial of the accused. No useful purpose will be served by continuing the case.

4. Accordingly, the case in C.C.No.200044 of 2016 on the file of District Munsif Cum Judicial Magistrate No. I, Hosur Taluk, Krishnagiri shall stand quashed and this Suo Motu Transfer Case stand disposed of. 10.09.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
