This application has been filed to condone the delay of 433 days in filing written statement.

2. The learned counsel for the applicant / defendant would submit that the plaintiffs are the brothers of the defendant and in view of the compromise talks between the parties, the written statement was not filed in time.

3. Though the respondents filed counter affidavit opposing this application, however considering the nature of prayer sought for in the suit and the delay, this Court is inclined to condone the delay.

Accordingly, the delay is condoned.

4. Post the matter on 25.11.2019.
