This petition has been filed to condone the delay of 235 days in filing the above appeal.
2. Heard Mr.C.Ramaraj, learned counsel takes notice on behalf of the petitioner and Ms.N.B.Surekha, learned counsel appearing for the third respondent. Though notice was served to the respondents 1 and 2, there is no representation for the respondents 1 and 2.
3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to order this petition.
4. Accordingly this petition is allowed. Registry is directed to number the appeal, if it is otherwise in order and post the matter for admission.
5. It is underscored that in the eventuality of the petitioner succeeding in the appeal to be taken on record, he would not be entitled to any interest for 235 days.
