A.No.8756 of 2019 in C.S.No.98 of 2019 N.SATHISH KUMAR.J., The learned counsel appearing for the applicant/defendant submitted that the present application has been filed to receive the documents described in the Judges Summons in the suit in C.S.No.98 of 2019.

2. Heard both sides.

3. The only contention of the learned counsel appearing for the respondent/plaintiff is that he has to file a formal counter.

4. Considering the submissions made by both sides counsel, I am of the view that the mere marking of the documents will not amount to proof of the document. Proof is separate aspect which requires evidence. Therefore respondent is at liberty to raise objection before the learned Master. The learned Master shall note down the objection raised by the respondent. Such objection will be dealt by this Court at the time of final disposal of the suit.

5. Post the matter on 27.11.2019.
