ORDER
This case is registered for alleged offence under Section 379 of the Indian Penal Code. The incident occurred on 14.03.2017. The accused, who saw a vehicle bearing the registration No.PY01 AK 2126 HERO HONDA SPIL worth Rs.40,000/- parked in front of the house of the de facto complainant residing at Bhavani Street, Villupuram taluk Police Station Circle, Villupuram Highways Nagar, at the margin of the house, committed a theft. Now, it is submitted by the prosecution that the property is recovered and handed over to the de facto complainant.

Considering the factual matrix, context of the case, the antecedents of the accused, the reason for absence from his usual place, and the submission that, despite best efforts, the summons/warrant could not be served/ executed, it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, and no useful purpose would be served.
3. Accordingly, the case in C.C.No.800153 of 2017 on the file of the learned Judicial Magistrate Court No.I, Villupuram Taluk, Villupuram, stands quashed. This Suo Motu Transfer Case is disposed of. 25.08.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
