Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the first respondent to dispose the statutory appeal filed under Section 10 of Land Encroachment Act by the petitioner on 11.09.2023 within a stipulated time.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.C.Prakasam, learned counsel for the petitioner and Mrs.R.Anitha, learned Special Government Pleader for the respondents.

2. We are not inclined to entertain the present petition. The appeal is filed on 11.09.2023. On 17.09.2023, the writ petition is filed seeking a direction to decide the appeal.

3. It is for the authorities to consider the appeal on its own merits. As far as stay is concerned, it is for the petitioner to file a stay petition and the same shall be considered expeditiously on its own merits.

4. In view of the above, the writ petition stands disposed of. There will be no order as to costs. Consequently, W.M.P.No.30431 and 30432 of 2023 are closed.
