JUDGMENT
(Order of the Court was made by R.Suresh Kumar J.) This Intra Court Appeal has been directed against the order passed by the learned Writ Court dated 27.07.2022, made in W.P.No. 2439 of 2015. That the Teachers Recruitment Board had issued a notification on 28.05.2013 inviting applications to the post of Assistant Professor in the Tamil Nadu Collegiate Educational Service for Government Arts & Science Colleges. 2.The writ petitioner/appellant was one of the candidate, who participated in the selection process under the category of Scheduled Caste (Ortho) in Commerce. He was not selected, therefore, he has approached the Writ Court seeking indulgence of the Writ Court.
3/6 3.The Writ Court having recorded the portion of the counter affidavit filed by the Teachers Recruitment Board has come to the conclusion that the writ petitioner/appellant has not come within the zone of consideration and therefore, he cannot be expected to be selected and therefore, the Writ Court dismissed the writ petition through the impugned order. 4.Today when the Writ Appeal is taken up for final hearing, Mr.R.Neelakandan, learned Additional Advocate General appearing for the Teachers Recruitment Board would submit that during the pendency of the Writ Appeal some developments had taken place, by which, one of the selected candidates though got appointment order, either could not join or joined left because he is no more. Therefore, the vacancy is caused and in that vacancy, since the writ petitioner comes next, he was selected and proceedings to that effect has been issued by the Teachers Recruitment Board dated 22.05.2025 and which has been communicated to the second respondent/the Directorate of Collegiate Education.
5.The learned Additional Advocate General also produced the copy of the said proceedings dated 22.05.2025, where, three such candidates have been
4/6 selected in the vacancy now caused, wherein, the third candidate is the writ petitioner/appellant, namely, P.Veerasamy, who has been selected under the quota Scheduled Caste (Ortho).
6.Pursuant to this communication dated 22.05.2025 of the Teachers Recruitment Board, the Directorate of Collegiate Education in turn has forwarded that communication with his comments on 15.07.2025 to the Secretary to the Government of Tamil Nadu, Higher Education Department for issuance of necessary appointment orders. Therefore, the learned Government Pleader appearing for the first and second respondents relying upon the communication dated 15.07.2025 of the second respondent would submit that the Government would soon issue the appointment order. 7.In view of the said development, as the writ petitioner/appellant himself having been selected and the appointment order is expected to be issued by the concerned authority, namely, the first and second respondents at any time, no further adjudication is required in the present Writ Appeal. Hence, recording the aforesaid development, the Writ Appeal stands disposed of. We expect that
5/6 the first and second respondents, as the case may be, being the authority would act upon immediately and to issue appointment order at the earliest, preferably, within one (1) month from the date of receipt of a copy of this order.
