The present Writ Petition has been filed for issuance of a Writ of Certiorarified Mandamus to call for the records of the 3rd respondent dated 16.02.2017 in proceeding Roc.No.101/2017/K1 and quash the same and direct the respondents to promote the petitioner to the post of Block Development Officer on the day his juniors were promoted along with all attendant benefits.

When the petition is taken up for hearing, the learned counsels on either side submitted that the petitioner has earlier filed W.P.No.17769 of 2010 seeking for issuance of a 'Writ of Certiorarified Mandamus calling for the records of the 3rd respondent therein dated 24.04.2001 in Letter Na.Ka.No.15599/2001/K3 and the consequential order dated 04.01.2010 in Roc.Bo.236/2010/K1 and the consequential order passed in Na.Ka.No.830/2010/K2 dated 10.05.2010, quash the same and direct the respondents to include the name of the petitioner in the panel fit for promotion to the post of Deputy Block Development Officer and promote him from the date on which his juniors were promoted, i.e., 15.12.2008' and this Court by an order dated 09.07.2020 allowed the said Writ Petition and 2/4
considered the claim of the petitioner, therefore, submitted that the claim of the petitioner in the present Writ Petition has already been considered. Considering the submissions of the learned counsels on either side stating that the claim of the petitioner has already been considered, nothing survives for further adjudication in the present Petition. Hence the present Writ Petition is hereby dismissed as infructuous. Consequently, connected miscellaneous petition is closed.
