O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(B), 25 of NDPS Act, 1985 and Section 4(1) (C), 4(1-A), (ii) of TNP (Amendment) Act, in Crime No.197 of 2025, on the file of the respondent Police, seeks anticipatory bail.

The petitioner herein is the 5th accused in Crime No.197 of 2025 registered on 25.05.2025 for the alleged offence under Sections 8(c), 20(b)(ii)(B), 25 of NDPS Act, 1985 and Section 4(1) (C), 4(1-A), (ii) of TNP (Amendment) Act. 1.329 Mg of Tablets containing psychotropic substances, 1 kg 100 grams Ganja and 32.4 liters of Karnataka liquor were seized from the vehicle bearing registration Nos.KA-03-MN-8514 and KA-03-NU-0746 while transporting from Bangalore to Hosur. The confession statement of the persons from whom the contraband seized has implicated this petitioner as the supplier of the contraband.

3. The learned counsel appearing for the petitioner submitted that except the confession statement no incriminating offence against the petitioner and he has been falsely implicated in this case.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police states that the liquor seized from the accused A1 to A3 sent for Chemical Analysis and the report is awaited.

5. Heard the learned counsels and perused the materials available on record.

6. Considering the fact that the petitioner is alleged to be the supplier of the contraband seized and he belongs to Karnataka, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions;

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on or before 08.09.2025 before the learned Judicial Magistrate No.I, Hosur, on condition that the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that:

[a] if the petitioner fails to surrender before the concerned Magistrate on or before 08.09.2025, this Order shall stand automatically cancelled;

[b] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [c] the petitioner shall stay at Krishnagiri and report before the Krishnagiri Town Police daily at 10.30 a.m., for a period of 30 days and thereafter as and when required for interrogation;

[d] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
