C.M.P.No.23784 of 2019 in C.M.A.No.SR.136719 of 2019 V.M.VELUMANI,J.

This petition is filed to condone the delay of 70 days in filing the above Civil Miscellaneous Appeal.

2.The learned counsel appearing for the petitioner submitted that the petitioner has filed the appeal only with regard to quantum of compensation and the 2nd respondent/owner of the vehicle is not necessary party and hence, notice to the 2nd respondent may be dispensed with.

Accordingly, notice to the 2nd respondent is dispensed with.

3.Though notice was served on the respondents 1 & 3 and their names are printed in the cause list, there is no representation on behalf of them either in person or through counsel.

4.Being satisfied with the reasons stated in the supporting affidavit filed for condonation, the delay of 70 days is condoned and the petition is ordered.
