PRAYER: To withdraw the petition in H.M.O.P.No.247 of 2024 pending on the file of the Family Court, Trichy and transfer it to the file of the Family Court, Namakkal and thus render justice.

PRAYER in C.M.P. To stay all further proceedings in H.M.O.P.No.247 of 2024 pending on the file of the Family Court, Trichy pending disposal of the above petition.

Heard.

2. This Transfer Civil Miscellaneous Petition has been filed by the petitioner/wife under Section 24 of the Code of Civil Procedure seeking withdrawal of H.M.O.P. No.247 of 2024 pending on the file of the Family Court, Tiruchirappalli and transfer of the same to the file of the Family Court, Namakkal.

3. The petitioner is the wife and she is residing at Namakkal. The learned counsel for the respondent would raise an objection submitting that the matter may be transferred only to some other adjacent District and would further submit that the respondent/husband is residing at Tiruchirappalli.

4. Having considered the submissions, this Court is of the view that, in a petition for transfer filed by the wife, the convenience of the wife ordinarily deserves primacy. In the facts placed, the petitioner is residing at Namakkal and the proceedings sought to be transferred are pending at Tiruchirappalli. Therefore, this Court is inclined to allow the transfer sought for.

5. Accordingly, Tr.C.M.P. No.1093 of 2024 is allowed and H.M.O.P. No.247 of 2024 pending on the file of the Family Court, Tiruchirappalli is withdrawn and transferred to the file of the Family Court, Namakkal, to be taken up and disposed of in accordance with law. The Family Court, Tiruchirappalli is directed to

transmit the entire records forthwith to the Family Court, Namakkal. In view of the above, C.M.P. No.24007 of 2024 is closed. No costs. 16-02-2026 dpq/ay Index:Yes/No Speaking/Non-speaking order To 1.The Family court, Trichy.
