These petition has been filed to set aside the order dated 21.07.2023 in I.A No. 143 of 2020 in O.S No. 208 of 2009.

2. Heard the learned counsel for the petitioner. 3.On perusal of the records, it reveals that the petitioner herein filed

the application to appoint advocate commissioner to inspect the suit property with the help of surveyor but the said application was dismissed by the Trial Court. Challenging the same the petitioner filed this petition. On seeing the facts of the case, the petitioner filed the petition to appointment of advocate commissioner. Hence, the appointing advocate commissioner to note down the physical features of the property will enable Court decide the issue quickly and also it would not cause any prejudice to the respondent Hence, the order passed by the Trial Court in I.A No. 143 of 2020 in O.S No. 208 of 2009 is set aside. Thus, in I.A No. 143 of 2020 in O.S No. 208 of 2009 is allowed. Accordingly, this petition is disposed of. No cost. consequentially, connected miscellaneous petition is closed.
