O R D E R

The petitioner herein claims ownership to the extent of 38 cents land which according to him, disturbed by the 2nd respondent while he attempted to put fence. Earlier, criminal case has already been registered against the 3rd respondent for a similar interference and registered FIR in Crime No.728 of 2018 on the complaint given by one Amaravathi, subsequently, this petitioner on 06.10.2018, has given a complaint but that complaint was closed undertaking from both the parties that they will resolve the dispute before the Civil Court. Since there is no title dispute between the parties, the petitioner herein had appeared and again given a complaint on 08.10.2023 and registered under CSR No.1230 of 2023.

2. The learned Government Advocate (Crl.Side) submitted that the said complaint yet to be enquired and if any protection is required, the Police will provide it in accordance with law.

3. Recording the same, this petition is disposed of. No costs. 16.11.2023 Index : Yes/No 2/5

Since the extent of land owned by the petitioner and the date of complaint wrongly mentioned in the order dated 16.11.2023, the learned counsel for the petitioner had given a letter to the Registry to list the matter under the caption 'for being mentioned'.

2. Today, the learned counsel appearing for the petitioner referring the documents pointed out the typographical errors in the order. The errors kept in the order dated 16.11.2023 is amended.

3. In the first line of the order extent of land mentioned as 38 cents to be corrected as 0.98 cents and the date of complaint mentioned as 06.10.2018 to be corrected as 06.10.2023.

4. Corrected order shall be issued to the petitioner free of costs.
