ORDER

The writ petition has been filed seeking issuance of a Writ of Mandamus, to direct the Respondent to review the suspension dated 28.01.2025 in the light of observations of the Hon'ble Division Bench made in the case of "S.Irulappan Vs the Revenue Divisional officer in Paragraph 4" and pass appropriate orders for considering the petitioner representation dated 14.08.2025.

The learned counsel appearing for the petitioner would submit that the petitioner was placed under suspension by order dated 28.01.2025 and thereafter, she had submitted a detailed representation dated 14.08.2025, requesting the respondent to review the suspension. He would further submit that the Hon'ble Division Bench of this Court in S.Irulappan Vs. The Revenue Divisional officer had, in paragraph 4, observed that suspension cannot be allowed to continue indefinitely and therefore, the respondent is bound to

review the same. Hence, a direction may be issued to the respondent to consider the petitioner's representation in the light of the said observations and pass appropriate orders within a time frame.

3. The learned Special Government Pleader appearing for the respondent would submit that the respondent is a Co-operative society and that a writ petition is not maintainable as against a Co-operative society.

4. Without going into the merits and considering the submissions made, since the relief sought is only for issuance of a writ of mandamus to consider the representation of the petitioner dated 14.08.2025, a direction is issued to the respondent to consider the representation of the petitioner and pass appropriate orders in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion with regard to the maintainability of the writ petition.

5. In fine, the writ petition stands disposed of. However, there shall be no order as to costs.
