ORDER
(Order of the Court was made by S.M.Subramaniam J.) The Writ Petition has been instituted challenging the notice issued by the Block Development Officer, Thiruvallur asking the petitioner to surrender the encroached portion of the property.
2. Such notice would provide no cause for institution of writ proceedings.
3. Prof.M.Udhaya Bhanu, learned counsel for the petitioner would submit that during the pendency of the suit, an application to District Collector for providing alternate accommodation has been filed. If any such application is received by the competent authority, it may be considered in accordance with the terms and conditions of the welfare scheme for providing accommodation to landless poor people. However, it is for the petitioner to pursue the application which was already pending before the competent authority.
4. As far as the present petition is concerned, the petitioner has not established any right for the authorities to consider the relief. Accordingly, the Writ Petition stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
