Original Petition is filed for grant of Probate in respect of the last Will executed by A.Kokilambal.

2.The applicant herein is the grand daughter of Kokilambal's brother Thillainayagam. The applicant is named as Executor by Kokilambal in her Will dated 22.06.2013. In the probate proceedings, the other second class legal heirs of Kokilambal are arrayed as respondents. Since the applicant is ordinary resident of USA, she has given power of attorney to the third respondent Rama Karthikeyan to act as her agent and conduct the case on her behalf. Though the third respondent apparently may have conflict of interest, since he has already given consent affidavit for grant of Probate in favour of the applicant, the application to recognize the third respondent as power agent of the applicant is permitted. Accordingly, this application is allowed.
