Petition under Article 226 of the Constitution of India, praying that in the circumstances stated therein, and in the affidavit filed therewith the High Court will be pleased to issue a Writ of certiorarified Mandamus to quash the impugned order dated 10.01.91 NO.D.V.5/91, Estt-1, of the 2nd respondent and order dated 11.04.91 of the first respondent and consequently direct the 2nd respondent to reinstate the petitioner to his Original post as constable in the all back wages and benefits.

JUDGMENT

( delivered by The Hon'ble Chief Justice ) The Writ Appeal arises out of an order passed in W.P.No.12969 of 1991 dated 10.02.1999.

Heard learned counsel for the appellants, who submits that there are no instructions about the whereabouts of the respondent/petitioner.

In the aforesaid circumstances, since the impugned order is twenty years old, the matter may not have been pursued by the respondent/petitioner on his own volition. Any further exercise would be infructuous.

Accordingly, the writ appeal is consigned to records without prejudice to the rights of the parties to make a request if any such cause of action arises. No costs. Consequently, connected miscellaneous petition is closed.
