Writ Petition is filed for issuance of a Writ of Mandamus to direct the 3rd respondent to reimburse an amount of Rs.19,476/- deducted from the settlement dues of the petitioner along with interest at 12% p.a and t pass such further or other orders.
2. Heard the learned counsel appearing for the petitioner as well as the learned counsel appearing for the respondents. By consent, the writ petition is taken up for final disposal.
3. The case of the petitioner is that the petitioner has retired on superannuation as Head Constable on 30.06.2016. From August 2007 to 08.04.2016 he was utlizing the quarters facility provided by the respondents by duly paying all charges. While so, on his retirement a sum of Rs.19,476/- was deducted from his settlement dues in an un-authorised manner, allegedly towards difference of payment of electricity charges. He sought for particulars by invoking RTI Act, since no proper information was made available to him, he issued legal notice to the respondent on 11.04.2019, but no reply has been received till date. Hence this writ petition.
4. Learned counsel appearing for the petitioner submitted that it would suffice, if this Court issues direction to the 3rd respondent to consider the petitioner's representation and pass appropriate orders within the reasonable time.
5. Considering the limited request made by the learned counsel appearing for the petitioner, this Court directs the petitioner to make out fresh representation to the 3rd respondent. Accordingly, the 3rd respondent is directed to consider the representation of the petitioner and pass appropriate orders on merits and in accordance with law, as expeditiously as possible.
