O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus to call for the records of the third respondent No.010600/OFF/CRS-251/11/2024 dated 06.08.2024 and No.010600/OFF/CRS-251/12/2024 dated 06.08.2024, quash the same, consequently direct the respondents to disburse the amount for medical bills to the petitioner.

2.The learned counsel appearing for the petitioner submitted that the petitioner is a family pensioner and member of Government of Tamil Nadu's New Health Insurance Scheme. She took treatment at Prasanth Hospitals for CKD stage 5 and thereafter made claim for reimbursement of the medical expenditure, however, the same was rejected on the ground that it was time barred. The learned counsel further submitted that as against the order impugned in this writ petition, appeal remedy is available to the petitioner before the District Legal Empowered Committee or State Level Empowered Committee or High Level Empowered Committee. Hence, this Court may without 2/4

going into the merits of the case, permit the petitioner to file appeal before the competent Empowered Committee and issue direction to the concerned Empowered Committee to dispose of the same within a reasonable time frame.

3.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court without expressing any opinion on the merits of the case, permits the petitioner to file appeal before the competent Empowered Committee, within a period of two weeks from the date of receipt of a copy of this order. On such appeal being filed by the petitioner, the concerned Empowered Committee is directed to consider the same and dispose of the same, within a period of four weeks thereafter.
