PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the first respondent herein to consider the petitioner's representation dated 21.06.2024 to sanction the Family pension and other monitory benefits to the petitioner and pass orders.

ORDER
By consent of learned counsel on either side, this writ petition is taken up for final disposal at the stage of admission itself.
2. This petition is filed seeking to issue a Writ of Mandamus directing the first respondent herein to consider the petitioner's representation dated 21.06.2024 to sanction the Family pension and other monetary benefits to the petitioner and pass orders.
3. The case of the petitioner is that the husband of the petitioner worked as a Gardner in the Tamil Nadu Housing Board and he was dismissed from the services vide proceedings No.DC-4/59/1998 dated 31.08.2004. The charges levelled against him is that he demanded and accepted a sum of Rs.20,000/- as illegal gratification with a promise for securing allotment of house under Government Discretionary quota. It is pertinent to note that the husband of the petitioner/C.Chinnathambi died on 28.10.2022 leaving behind the petitioner/wife, daughter and son as his legal heirs. The grievance of the petitioner is that as her husband served in the organisation for 31 years, the petitioner's family is entitled to avail 2/5
benefits such as compassionate appointment, family pension any other benefits which come under the Government Policy. Hence, the petitioner gave a representation to the first respondents on 21.06.2024 and the same was not considered till date. Hence, this petition.
4. The learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the respondents to consider petitioner's representation dated 21.06.2024 and pass orders.
5. The learned Standing Counsel appearing for the respondents submits that they will consider the case of the petitioner on merits and in accordance with law.
6. Considering the facts and circumstances of the case and the limited relief sought for by the petitioner, this Court, without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner's representation dated 21.06.2024 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner is directed to co-operate 3/5
with the respondents and produce all the available documents to establish her case.
7. With the above observations this writ petition stands disposed of. No order as to costs.
