ORDER
The present writ petition is filed praying for a writ of Mandamus directing the respondents to pay appropriate compensation to the petitioner for the lands claimed to be unlawfully acquired by the respondents from the petitioner's property comprised in Survey No.11/3, situated at Velankanni Region, Nagapattinam District measuring an extent of 3.75 cents, by considering petitioner's representation dated 12.08.2024.

At the outset, Mr.Ramanlal, learned Additional Advocate General appearing for 8th respondent would submit that there are doubts as to whether the claim by petitioner that road has been laid on is a patta land. He would thus submit that survey was conducted earlier and that re-survey would be conducted at petitioner's property. Pursuant to the survey report, appropriate proceedings will be taken including considering the petitioner's request for compensation, if in fact a road has already been laid in the petitioner's property by the appropriate authority authority for determining compensation i.e., the 4th respondent. Agreed to by the learned counsel for petitioner.

3. In view thereof, the writ petition stands disposed of with a direction to the appropriate respondent to re-survey the petitioner's property. Based on the survey report, if it is found that road has been laid in petitioner's property, 4th respondent shall consider petitioner's request for compensation and pass appropriate orders in accordance with law after affording a reasonable opportunity of hearing to the petitioner and other interested parties. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. No costs.
