ORDER

This petition has been filed challenging the Non Bailable Warrant issued by the Court below against the petitioner who is facing the trial before the Court below for an offence under Section 138 of the Negotiable Instruments Act. 2.At the time of entertaining the Criminal Original Petition, this Court had directed the trial Court not to execute the Non Bailable Warrant. Due to passage of time, no useful purpose will be served by keeping Non Bailable Warrant pending and it will be better if the same is recalled and the parties are directed to agitate their case before the Court below on merits.

3.Heard the learned counsel for the petitioner and the learned counsel appearing on behalf of the respondent. 4.In view of the above, the Non Bailable Warrant issued against the petitioner by an order dated 06.11.2017 is hereby recalled. The petitioner is directed to appear before the Judicial Magistrate No.1, Pollachi on or before 18.06.2019 and shall execute a bail bond for the sum of Rs.5,000/-. proceed further with the case and complete the proceedings in C.C.No.32 of 2006 within the period of two months from the date of receipt of a copy of this order.
