ORDER
Heard.
This Transfer Civil Miscellaneous Petition is filed by the wife to withdraw F.C.O.P.No.218 of 2025 from the file of the Family Court, Vellore, and transfer the same to the Family Court, Coimbatore.
3. The petitioner is the wife. She states that the marriage between the petitioner and respondent solemnized on 15.09.2024 and she is now residing at Coimbatore with her parents. She submits that the respondent/husband has filed F.C.O.P.No.218 of 2025 before the Family Court, Vellore seeking a declaration of nullity of marriage.
4. It is the case of the petitioner that she finds it difficult to attend the proceedings at Vellore and that she has to travel about 380 kms to and fro by incurring huge expenses and hardship, and therefore seeks transfer to Coimbatore.

5. The respondent has filed a counter and has stated that he does not oppose the transfer of F.C.O.P.No.218 of 2025 to the Family Court, Coimbatore, and undertakes to cooperate.
6. The learned counsel for the petitioner submits that the respondent has already given no objection for transfer of the case from Vellore to Coimbatore which has been duly endorsed.
7. The learned counsel for the respondent submits that recently the respondent had met with an accident and is residing at Bangalore and the wife is staying in P.G.hostel, Coimbatore and the changed circumstances appears to oppose the petition.
8. This Court has considered the rival submissions. In transfer petitions arising out of matrimonial proceedings, the convenience of the wife and the need to ensure effective participation in the proceedings are relevant considerations. In the case on hand, the petitioner is residing at Coimbatore and pleads travel hardship. The respondent also has not 3/5
opposed the transfer in the early point of time, and the situation of the respondent in the present appears transient Hence, this Court is of the view that the transfer sought deserves to be ordered.
9. Accordingly, Tr.C.M.P. No.923 of 2025 is allowed. F.C.O.P. No.218 of 2025 on the file of the Family Court, Vellore, is withdrawn and transferred to the file of the Family Court, Coimbatore. The Family Court, Vellore, shall transmit the entire records to the Family Court, Coimbatore, within three (3) weeks from the date of receipt of this order and the Family Court, Coimbatore, shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Interim stay granted by this Court on 26.08.2025 shall stand vacated and C.M.P. No.20967 of 2025 is closed. There shall be no order as to costs.
